Amicus Brief - City of Oakland v. Oakland Raiders

 

WASHINGTON - Open Markets Institute filed an amicus brief urging the Supreme Court to hear City of Oakland v. Oakland Raiders. The brief focuses on how the lower courts have effectively rewritten and narrowed the strong private right of action for antitrust violations. In Section 4 of the Clayton Act, Congress allowed "any person" injured in their business or property by an antitrust violation to obtain treble damages and recover their attorneys' fees. Open Markets called on the Supreme Court to correct the errors of the lower courts and restore the plain meaning of the Clayton Act.
